These Terms & Conditions (“Terms”) govern your access to and use of DailyWorks.io (the “Service”), operated by [Company Legal Name] (“DailyWorks”, “we”, “us”). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
1. The Service
DailyWorks.io is a multi-tenant software platform for construction and scaffolding operations, providing client and project management, daily work reporting, scaffolding logistics tracking, and related reporting and analytics. We may add, change, or remove features over time.
2. Accounts & Eligibility
You must provide accurate account information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. We strongly recommend enabling two-factor authentication. Notify us immediately of any unauthorized use. Each company (“tenant”) is responsible for managing its own users and the access it grants them.
3. Acceptable Use
You agree not to:
- use the Service in violation of any applicable law or regulation;
- attempt to gain unauthorized access to the Service, other tenants’ data, or related systems;
- interfere with or disrupt the integrity or performance of the Service;
- upload content that is unlawful, infringing, or that you do not have the right to submit; or
- reverse engineer or attempt to extract the source code of the Service, except to the extent permitted by law.
4. Customer Data & Content
You retain all rights to the data you and your users submit to the Service (“Customer Data”), including clients, projects, daily reports, photographs, and scaffolding records. You grant us a limited license to host, process, and transmit Customer Data solely to provide and improve the Service. You are responsible for the accuracy and legality of Customer Data and for having the necessary rights to submit it.
5. Subscriptions & Fees
Where the Service is offered on a paid basis, applicable fees, billing cycles, and payment terms will be set out in a separate order or plan description. Unless stated otherwise, fees are non-refundable and exclude applicable taxes (including VAT).
6. Intellectual Property
The Service, including its software, design, and branding, is owned by DailyWorks and its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, no rights are transferred under these Terms.
7. Service Availability & Warranties
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
8. Limitation of Liability
To the maximum extent permitted by law, DailyWorks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service shall not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or where required by law. Upon termination, your right to use the Service ceases; we will handle Customer Data in accordance with our Privacy Policy and applicable law.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of Cyprus, and the courts of Cyprus shall have exclusive jurisdiction, without prejudice to any mandatory consumer protections that may apply to you.
